Patrícia Henriques Lda., hereinafter referred to as PH SHOES, with its registered office at Rua Nóbrega e Sousa Nº3 1ºB, 1750-440 Lisbon, municipality of Lisbon, is registered in Portugal under the number 514 075 724. 

  1. USE OF THE SERVICE
  • The customer undertakes to use this service in fulfilment of applicable laws and regulation in force, as well as the Terms and Conditions listed herein.
  • PH SHOES may, at any time, amend, in whole or in part, the Terms and Conditions set forth herein.
  • The customer may not amend the contents of the Service or send messages containing computer viruses, or which may cause other kinds of damage;
  • The customers of the online store are regarded as end customers, subject to the payment of VAT, with the exception of residents of third-party countries, outside the European Union.
  • The sales process is subject to compliance with the standards set forth under Law no. 25/2008 of 5 June, regarding the system for preventing and suppressing benefits with illicit origin in money laundering and terrorism financing.
  1. PRODUCTS AT THE ONLINE STORE
  • Products duly identified in the corresponding catalogues can be purchased.
  • If a product is not available online, that does not mean it is sold out, as it may be available via another of the brand’s distribution channels.
  • If the model and/or size are not in stock, you can choose to be notified when it becomes available.
  1. PRICES
  • The prices shown include VAT at the legal applicable rate at the time the product is purchased, plus the corresponding shipping costs. The price of the products, the VAT amount, as well as the postage and shipping cost are duly broken down prior to the purchase’s final validation stage.
  • The product’s purchaser shall be solely responsible for any other expenses resulting from the delivery of orders abroad, namely customs clearance expenses.
  1. ORDERS
  • Products are ordered by being placed in the shopping cart, filling in the invoicing and delivery information, and completing the purchase via the payment methods available at the online store.
  • Orders can be cancelled via e-mail (contact@phshoes.com), within 24 hours of being confirmed.
  • The cancellation request shall take effect only when the order number and customer name are provided.
  • PH SHOES reserves the right to cancel any order that cannot be verified, or processed.

Multibanco (ATM)

Payments via Multibanco (ATM) can be made via the Multibanco ATM Network, or via your Homebanking.

Upon completing your order, a Multibanco (ATM) reference will be generated. You will receive this reference in the e-mail confirming your order.

To make this payment at a Multibanco (ATM), please select the option “Pagamento de Serviços/Compras” (Payment of Services/Purchases) and enter the corresponding entity, reference and amount.

MBWAY

Payments via MBWAY entail confirmation of your purchase on your smartphone.

Upon completing the purchase, enter your mobile phone number linked to your MBWAY account and you will receive a notification on your smartphone to validate your purchase. Your order will be processed after validation.

The products shall remain reserved for 48h. If PH SHOES does not receive payment for the order during that timeframe, the order will be cancelled.

  • If you have a discount code, you can use it at the online store, under the conditions set forth. It should be pointed out that discount codes cannot be cumulated.
  1. DELIVERY POLICY
  • There are delivery fees that will be shown during the order procedure.
  • In Mainland Portugal, orders are generally delivered within 3 business days after the date of the corresponding payment.
  • In the European Union, the delivery period can range from 3 to 5 business days.
  • Deliveries to the rest of Europe and to other countries vary according to the destination, shipping time, and customs processing; however, delivery is estimated to take as many as 8 business days.
  • Deliveries are made via the courier DHL.
  • Deliveries to countries outside the European Union are made with DDU (Delivery Duty Unpaid), meaning that any import duty, or sales tax applicable in your country, shall be paid by you to the shipping company at the time of delivery.
  • If an out-of-stock situation occurs, you will be duly informed before we proceed with the delivery.
  • Customised models will be produced especially for you, with delivery time expected to range from 4 to 8 weeks, depending on the complexity of the work, with the delivery date being communicated and agreed upon in advance with the customer.

7. CANCELATION POLICY

It is possible to cancel your order and have your payment refunded within 72h, if the cancelation takes place before the package is sent to the customer, which occurs within 24 to 48h after confirmation of payment takes place. Otherwise, you will have to await the package delivery and then follow the steps described below:

  • Contact us at contact@phshoes.com, referring your order number.
  • The product shall be returned in its original packaging and as a complete set – pair of shoes, box and bag. There shall be no smell, mark showing use, or modification relative to the time the product was received, including cleaning by the customer.
  • The product should be returned within a maximum of 10 working days.

  • Shipping costs from a order cancellation are at the expense of the customer.
  • We will notify you by email, once your parcel has been received and processed internally. 
  • We will refund you, using the same payment method used at the time of order confirmation.
  • Shipping fees are not refundable.
  • International customs duties and sales taxes are not refundable (deliveries outside the European Union)
  • Please allow up to 10 business days for completing the refunding process.

Notice: The return of products not in compliance with the aforementioned conditions shall not be accepted; such products shall be automatically returned to the sender’s address

8. EXCHANGES AND RETURNS

  • Delivery of products purchased through this service complies with the Portuguese legislation on distance commerce (Decree-Law no. 82/2008 of 20 May).
  • We do not accept exchanges and returns of personalised/customised products.
  • The customer has the right to complain about any product defect, inaccuracy or inadequacy relative to what was ordered, within the timeframes legally set forth for such purpose. You have 14 days to do so.
  • For purchases made in Portugal, returns or exchanges of catalogue products are free of charge, within 14 days, if, for whatever reason, you do not like your shoes, or you need to exchange them for a more appropriate size. For other countries, shipping costs are borne by the customer.
  • PH SHOES shall bear return shipping expenses, regardless of the country where delivery was made, when the item is damaged/defective, or if an error has occurred in its shipment.
  • PH SHOES shall not be held responsible for delivery and return expenses, where applicable, of any deliveries returned due to multiple delivery attempts, insufficient address, or refusal.
  • The product shall be returned in its original packaging and as a complete set – pair of shoes, box and bag. There shall be no smell, mark showing use, or modification relative to the time the product was received, including cleaning by the customer.
  • To return or exchange items, you will need to contact us at contact@phshoes.com, referring your order number.
  • Should you wish to return the items ordered from PH SHOES, and once the product is received and processed internally, you will be notified via e-mail.
  • The customer shall be refunded via the payment method originally used for confirming the order.
  • Shipping fees are not refundable.
  • International customs duties and sales taxes are not refundable (deliveries outside the European Union).
  • Please allow up to 10 business days for completing the refunding process.

9. REGISTRATION AT THE ONLINE STORE

  • Individual registration at the online store is made at the store under “Registration.”
  • The registration allows for a swifter purchasing process, while recording the customer’s identification information, thus enabling immediate recognition thereof, without having to re-enter such information during a future purchase.
  • Customers can update their personal information online, whenever making a purchase at the online store.
  • Access is restricted to every user and ensured via the use of a login and a password that should be changed when first using said login.
  • After registration, this information is sent to the customer’s e-mail for confirmation, as the customer shall be solely responsible for subsequent use thereof.

  • In compliance with Law 67/98 of 26 October, regarding Personal Data Protection, we hereby inform that the processing of personal information collected via the website phshoes.com is the responsibility of the company Patrícia Henriques Lda..
  • The information collected via this website is intended for processing orders and for communicating with customers, invoicing, processing information requests and possible complaints, statistical analysis, as well as its corresponding use for direct marketing purposes.
  • We collect the name, size that the customer wears/purchases, landline/mobile phone number, postal address, taxpayer number (optional) and e-mail address, for the purposes of the order’s internal processing, invoicing and delivery.

  • Should customers wish to verify the information submitted to PH SHOES, they may do so in their personal account. All customers have the right to access, correct, cancel and oppose their data. Should you, at any time, wish to no longer be part of the phshoes.com database, you can exercise such right via Customer Service or via the restricted area. Customers shall keep safe the information regarding access to their accounts, since they shall be responsible for any and every action or request made through their account. We advise customers not to store their password in their browser, as another person with access to their computer could see it and use their personal information.

11. APPLICABLE LEGISLATION AND COMPETENT JURISDICTION

  • The Portuguese law shall apply.
  • For settling emerging legal disputes, the jurisdiction of the District of Lisbon shall be the competent court of law, with express waiver of any other.
